Online purchaseterms

1. General provisions

These Online Purchase Terms apply to all orders placed through www.zapletrakija.rs. Matters not covered by these terms are governed by the Serbian Consumer Protection Act and the Law on Obligations.

2. Ordering and contract formation

You place an order by adding products to the cart and confirming the purchase on the checkout page. After receiving your order we send you an e-mail confirmation — the contract is concluded when we confirm the order. We reserve the right to refuse an order if a product is unavailable or the order details are incomplete, in which case we will notify you.

3. Prices

All prices are stated in Serbian dinars (RSD) and include VAT. Delivery costs are shown separately, before you confirm the order. The price applicable at the time of ordering prevails.

4. Payment

You may pay by cash on delivery or by a payment card accepted on Banca Intesa’s secure hosted payment page.

For card payments, card details are entered only on the bank’s page and are not disclosed to Zaplet. The order amount is authorised and reserved after a successful payment, then captured when the shipment is created. If authorisation is unsuccessful, the cardholder’s account is not charged. The order confirmation page and order e-mail include the transaction identifiers required by the bank.

5. Delivery

We deliver via courier within the Republic of Serbia. The delivery period is normally up to 3 working days from order confirmation. Delivery costs 500.00 RSD per parcel, and delivery is free for orders above 6,000.00 RSD. If an order cannot be delivered within that period, we will notify you and agree a new deadline or a refund.

6. Age verification at delivery

We sell alcoholic beverages exclusively to adults. The courier may request proof of age at handover; if the recipient cannot prove they are 18 or older, the parcel will not be handed over.

7. Right of withdrawal

You have the right to withdraw from a distance contract within 14 days of receiving the goods, without giving a reason, by sending a withdrawal statement to vladimir.puric@cherryhill.rs or to the seller's address. The deadline is met if the statement is sent before it expires.

You return the goods at your own cost, within 14 days of the withdrawal statement, unopened and undamaged, in the original packaging. You are liable for any diminished value of the goods resulting from handling beyond what is necessary to establish their nature and characteristics. We refund the payment without delay and at the latest within 14 days of receiving the statement, but may withhold the refund until we receive the goods back or you provide proof of return shipment.

For cash-on-delivery payments, we issue refunds using the same payment method as the original transaction unless we expressly agree otherwise with you and this does not result in additional costs. For all card payments, the Refunds section applies without exception: funds are returned exclusively to the account of the card used for payment.

8. Complaints and conformity

The seller is liable for the conformity of the goods for two years from the date the risk passes to the consumer. Complaints can be submitted to vladimir.puric@cherryhill.rs or to the seller's address, together with the receipt or other proof of purchase. We respond to a complaint within 8 days of receipt and resolve it within 15 days of receipt, with your agreement on the remedy (repair, replacement, price reduction or contract termination).

9. Out-of-court dispute resolution

A consumer dispute may also be resolved out of court, before the bodies for out-of-court resolution of consumer disputes registered with the ministry responsible for consumer protection. Our participation in such proceedings is mandatory under the law.

10. Changes and contact

We may amend these terms from time to time; the terms in force at the moment an order is placed apply to that order. 11. Customer support and order cancellation

Include your order number and a description of your request. To request cancellation before dispatch, contact us as soon as possible so we can check the order status. If the parcel has already been dispatched, the withdrawal and return procedure described in these terms applies. Contact us for shipping instructions before returning goods; the registered office address is not automatically the address for receiving returns.

12. Delivery and sales restrictions

Online orders are delivered exclusively within the Republic of Serbia; international delivery and export are not available. This online shop therefore does not offer international shipping or calculate import duties. The sale and delivery of alcoholic beverages are restricted to persons aged 18 or older. Delivery periods and payment timing are stated in the Delivery and Payment sections.

13. Currency conversion statement

Prices in this shop are currently displayed exclusively in RSD. The part of the following statement about informational displays in other currencies applies only if such a display is introduced; payments remain in RSD.

All payments will be made in the local currency of the Republic of Serbia – dinar (RSD). The middle exchange rate of the National Bank of Serbia is used for informational price displays in other currencies. The amount charged to your payment card will be expressed in your local currency through conversion at the exchange rate used by the card organisations, which cannot be known to us at the time of the transaction. As a result of this conversion, there may be a slight difference from the original price stated on our website.

14. Customer privacy protection

On behalf of Zaplet, we undertake to protect the privacy of all our customers. We collect only essential, basic customer/user data and the data necessary for business operations and for informing users in accordance with good business practices and in order to provide a quality service. We give customers a choice, including the choice of whether or not they wish to be removed from mailing lists used for marketing campaigns. All user/customer data is kept strictly confidential and is available only to employees who need it to perform their work. All Zaplet employees (and business partners) are responsible for respecting the principles of privacy protection.

A purchase does not require marketing consent. You may decline marketing messages and the use of your data by third parties for marketing purposes; you may withdraw consent by unsubscribing from a message or contacting vladimir.puric@cherryhill.rs. Data needed to fulfil an order is shared only with service providers who need it for that purpose, as described in the Privacy Policy.

15. Protection of confidential transaction data

When payment card details are entered, confidential information is transmitted over the public network in a protected (encrypted) form using the SSL protocol and PKI system, as the most advanced cryptographic technology currently available.

The security of data during purchases is guaranteed by the payment card processor, Banca Intesa ad Beograd, so the entire payment process takes place on the bank’s pages. At no time are payment card details available to our system.

16. Refunds

If goods are returned and a refund is made to a customer who previously paid by a payment card, in part or in full and regardless of the reason for the return, Zaplet is obliged to issue the refund exclusively through VISA, EC/MC, Maestro, Amex and Dina payment methods, meaning that the bank will, at the seller’s request, refund the funds to the cardholder’s account

For a cancellation or refund, provide your order number to customer support. A card transaction is refunded by reversing the original transaction exclusively to the account of the card used for payment, never in cash or to a different account. If the amount has only been reserved and the goods will not be dispatched, we initiate release of the reservation. Refund deadlines and return shipping costs are described in the Right of withdrawal section; the complaint procedure is described in the Complaints and conformity section.

17. VAT statement

VAT is included in the price and there are no hidden costs

Delivery costs are shown separately before order confirmation and are included in the final amount payable.

18. Model withdrawal form

Complete and send this form only if you wish to withdraw from the contract. You can send it by e-mail to vladimir.puric@cherryhill.rs or by post to the seller's address. You may also exercise the right of withdrawal by any other unambiguous statement, in accordance with the law.
